<p>Michalis Economides studied at Queen Mary University of London and University College London (UCL) before becoming a Barrister-at-Law from Lincoln’s Inn.</p>
<p>As he tells GOLD, the idea of founding his own law firm began to take shape during his legal studies.</p>
<p><strong><em>“When I was in the UK, I had the privilege to work in a major law firm, handling various arbitrary, corporate and court cases. Through my interactions with fellow professionals and my experience of operating in that environment, I realized that the legal profession could fulfil me and give me a solid purpose: offering advice and services to business and individuals, assisting in dispute resolution and providing solutions to personal or business problems”.</em></strong></p>
<p>Michalis Economides decided to follow his instincts regarding the profession, and as he gave more thought to what he could do to contribute to any changes and improvements, he moved a step further:</p>
<p><em><strong>“I realized that, to make the desired changes, I needed to have my own law firm, and that is what led to the formation of Chambersfield Economides Kranos.”</strong> </em></p>
<p>Seven years after its establishment, Chambersfield Economides Kranos has a physical presence in nine countries.</p>
<p>Its experienced team of lawyers undertakes cases that fall within the scope of litigation and arbitration, corporate and commercial law, admiralty and shipping, banking and finance, competition law, criminal law, debt recovery, employment law, energy law, European law, family law, immigration law, tenancy issues, intellectual Property law, internet business law, real estate and tax law.</p>
<p>Meanwhile, the firm’s sister company, GFA Trust, provides corporate, fiduciary and commercial services in more than 21 jurisdictions.</p>

<p>In addition to those two major crises, law firms face other significant challenges: “I believe that the legal sector needs to enter the digital era dynamically and embrace it by simplifying and speeding up all its procedures with the aim of improving communication among all the involved parties,” says Michalis Economides.</p>

										<content:encoded><![CDATA[<p>The 4th EU Anti-Money Laundering Directive (AMLD4) came into force on 26 June 2015. It replaces the 3<sup>rd</sup> EU Anti-Money Laundering Directive and its purpose is to strengthen and improve existing anti-money laundering and counter-terrorist financing laws.</p>

<p>It will also ensure consistency in the application of such laws across all EU Member States.</p>

<p><strong>History</strong></p>
<p>The 1st Anti-Money Laundering Directive (AMLD) was enacted in 1991 and primarily concerned drug-related offenses, initiating monitoring requirements that financial institutions had to adhere to, such as reporting all suspicious transactions.</p>
<p>In 2001, the 1st AMLD was replaced by the 2nd AMLD, which mainly harmonized the framework of the European Union with that of the Financial Action Task Force (FATF).</p>
<p>In 2005, the 3rd AMLD came into force, extending the Anti-Money Laundering (AML) coverage, in connection with certain businesses and professions, such as accounting and legal services, as well as establishing a risk- based method applicable to customers (due diligence).</p>
<p>Additionally, the 3rd AMLD introduced the notion of simplified due diligence (SDD) and enhanced due diligence (EDD).</p>
<p>More recently, terrorist incidents and the leaking of the so-called ‘Panama Papers’ indicated the need for new, stricter regulations in order to prevent tax fraud, money laundering and terrorist financing.</p>
<p>The main aim is to safeguard the financial systems of member states from abuse: the releasing of illegitimate funds laundered via business entities that end up committing severe criminal offences, with harmful consequences for society as a whole. In fact, the European Commission has taken up the fight against tax avoidance, money laundering and terrorism finance, very seriously and, in 2015, the EU proceeded with the introduction of the most comprehensive AML legislation in Europe, with a two-year implementation period for the member states.</p>
<p>The 4th AML Directive (AMLD4) applies to a diversified number of businesses (referred to as “<em>obliged entities</em>”) which, regardless of their size and business volume, are conducting financial transactions.</p>
<p>The main scope of AMLD4 is to further intensify the ownership transparency of firms, by strengthening standard practices:</p>
<p>Know Your Customer (KYC), Customer Due Diligence (CDD) and Politically Exposed Persons (PEP’s). Basically, AMLD4 will be implemented in many types of businesses, from financial institutions to gaming companies, real estate agents and traders, when proceeding with transactions in cash form exceeding €10,000.</p>
<p>In addition, AMLD4 introduces the prerequisite of a significant requirement for member states: the establishment of national registers of the beneficial owners of companies and business-related trusts, which will be interconnected, so as to achieve and enhance collaboration between the member states and local competent authorities. Law firms and banking institutions, as well as individuals or entities with a proven legitimate interest, will have access to the new central registers.</p>
<p>In summary, through AMLD4, the European Union is introducing strict regulation for tackling money laundering and terrorism financing, so as to safeguard its financial system from being used fraudulently.</p>
<p>&nbsp;</p>
<p><strong>Key Changes</strong></p>
<p>The key changes introduced by AMLD4 may be summarized as follows:</p>
<ul>
<li>Further enhancement of Customer Due Diligence (CDD). AMLD4 specifies that only through the provision of adequate documentation and risk analysis may simplified CDD be applied.</li>
<li>Additional emphasis is placed on the concept of Ultimate Beneficial Ownership (UBO), which, under Article 3 (6) of AMLD4, means <em>“any natural person who ultimately owns or controls a company, or who holds more than 25% of the issued share capital”.</em></li>
</ul>
<p>As per the new provisions, company ownership can no longer be anonymous and shareholders’ information should be public.</p>
<p>Legal entities and individuals should hold sufficient, accurate, up-to-date data regarding the UBO and the information is to be available at any time, upon the request of the responsible authorities. Moreover, the same practice applies to business trusts, trustees and beneficiaries.</p>
<ul>
<li>A more detailed definition of a Politically Exposed Person (PEP) is introduced. The Directive expanded its coverage by including national PEPs, not just foreigners, as high-risk customers due to exposure through their public position. Additionally, the Directive includes “family members” and close associates, as well.</li>
<li>According to AMLD4, PEPs are under a 12th month “surveillance period” that may be prolonged and should be periodically evaluated as per the sanction lists of each business sector.</li>
<li>The cash payment threshold has been reduced to €10,000 from €15,000 and could be set even lower on a national level.</li>
<li>Occasional transactions – referred to as any dealings outside the scope of a regular business relationship – of €15,000 euro and more must also be monitored.</li>
<li>E-Money products are regulated for the first time under AMLD4.</li>
<li>AMLD4 integrates the entire gambling sector, not just the casino industry as per previous Directives.</li>
</ul>
<p>In addition, the 4th AML Directive prescribes that “<em>obliged entities</em>” should review and verify at all stages Customer Due Diligence (CDD) by adapting a risk-based approach and undertaking ongoing monitoring, so as to specify the degree of risk through, inter alia, KYC assessments, and thus proceed accordingly, either by accepting the transaction or reporting it to the Financial Intelligence Unit (FIU) as suspicious.</p>
<p><strong> </strong></p>
<p><strong>Know your Customer | </strong><strong>(KYC) and the Risk-Based Approach</strong></p>
<p>The Know Your Customer (KYC) assessment responds to questions concerning the origin of the money in a transaction, the reason for the transaction, the intention and nature of the transaction, as well as the engaging parties.</p>
<p>As far as the risk-based approach in AMLD4 is concerned, it has been observed that it now has a wider coverage, describing risk assessment and CDD in a more detailed and descriptive way. Business owners must perform their own evidence-based decision making, referred to in the Directive as a <em>“holistic risk-based approach</em>”, so as to identify any risk of money laundering and financing of terrorism, depending on the nature and activities of their business. Basically, business owners are obliged to be constantly up to date and to take into consideration all the</p>
<p>facts associated with a customer’s profile and origin, cash flow and annual turnover, jurisdiction and/or geographical area, services, products, business deals and/or distribution channels and methods.</p>
<p>&nbsp;</p>
<p><strong>Making the Transition</strong></p>
<p>The changes that AMLD4 brings to business operations are significant and businesses have immense challenges to overcome.</p>
<p>However, AMLD4 has made breakthrough advances as regards the approach to the control, monitoring and prevention of money laundering and terrorism financing.</p>
<p>First – and most importantly in my opinion – businesses need to thoroughly educate their personnel and implement control procedures through compliance checklists, so as to ensure that they are conforming to all required specifications, policies, standards and regulations.</p>
<p>Secondly, firms need to fully comprehend AMLD4 and its requirements, so as to be able to identify the risk analysis procedures, specify the methodology and structure to be followed, establish and apply control mechanisms and checklists for an up-to-date CDD, and formulate the procedures for reassessing existing clients and assessing new ones.</p>
<p>In summary, the impact of AMLD4 on businesses goes way beyond affecting resources and mostly concerns the application of risk management, comprehending and blueprinting their current operations so as to set up processes that constantly comply with legislation and the regulations of this Directive and others that will follow.</p>
<p>The businesses and corporations to which AMLD4 is applicable are obliged to appoint professional compliance officers and invest in their ongoing education. Most importantly, such businesses and corporations may also outsource such significant tasks to third party professional entities, i.e. law firms, for ongoing support in compliance, training of their in-house personnel and providing an up-to-date overview of their AML policies and practices.</p>

<p>The liberalization of markets, the economic penetration in other jurisdictions, the transnational agreements that allow freedom of movement between the member states, the immediate transfer of capital and the rapid technological developments have overturned the world market equilibrium.</p>
<p>These changes have altered the way of doing business by turning companies’ activities from local to international; however, these changes also aided the spread of crime in the economic sphere. It is important to mention that the opening of the markets and the free movement of people and capital, have favored the growth of the economy while in some cases also favored the money-laundering activity.</p>
<p>European Union, International Organizations and Intergovernmental Organizations and States, in an effort to control illegal activities, have enforced laws and adopted directives which aimed at eliminating this phenomenon and further institutionalizing any movements taking place between the markets.</p>
<p>In the fight against these illegal activities, technology plays a leading role because of its ability to collect, control, analyze and broadcast, in real time, information that helps identify suspicious criminal and money-laundering activities. These technologically advanced systems use internationally specialized, integrated databases which assist the investigation process for suspected criminal activities.   Consequently, these systems are valuable allies to the legislator since they assist on monitoring the compliance of businesses and legal entities, on the basis of regulations, laws and directives as listed in the legislative framework.</p>
<p>Following the adoption of the <a href="http://www2.eklawyers.comportfolio-item/4th-eu-anti-money-laundering-directive">4th European Directive 2015/849</a> of the European Parliament and the Council of 20 May 2015, as well as, the publication of the 5th European Directive 2018/843 on 19 June 2018, the provisions of which should be applied at State level in 18 months (January 2020), many reports and discussions have been strongly stressed about the difficulties and high costs involved in harmonizing business and financial institutions. Taking into consideration that money-laundering and terrorist financing undermine the stability and credibility of a country&#8217;s financial institutions and systems, have the ability to distort statistical growth rates while discouraging investment by foreign investors and negatively affect inflows of capital from the international market, the short-term costs that we have to bear today will, in the long run, be overcovered by the steady, healthy economic growth of the country.</p>
<p>The efforts for preventing and combating money laundering and terrorist financing, currently being made by the supervisory authorities and businesses in Cyprus i.e. financial institutions, law firms, etc. at a State, European and International level, are being considered to be amongst the strongest competitive advantages of Cyprus.</p>
<p>The enforcement of these laws offers multiple benefits for Cyprus, such as a healthy and steady increase in the country&#8217;s economic aggregates and improvement in the overall quality of life. Terrorism, all kinds of criminal activity and tax evasion are major problems of every society, causing undesirable consequences such as economic and social instability, trade insecurity and lifestyle, as well as high costs of social harm.</p>
<p>Subsequently, the successful implementation of directives and regulations against money-laundering, are positively contributing in the restoration of Cyprus&#8217;s trust and reputation as a safe investment destination.</p>

<p>There are many cases where investors, real estate agents and construction companies have questioned whether a real estate agreement requires the appointment and supervision of a professional lawyer.</p>
<p>Even more times we heard that the contract is only typical and meets the basic requirements of the law or that the contract is standard, follows a specific pattern and does not require any change.</p>
<p>A contract, even when the transaction appears simple and straightforward, does not cease to be the most important document of the transaction, as it defines the rights of the parties involved and the appropriate actions on how to resolve various disputes that may arise. Additionally, a proper and careful contract limits all possible risks and prevents uncertainties, which could lead to disagreements.</p>
<p>As an international law firm that frequently deals with multiple and complex real estate transactions, we have unfortunately encountered many cases in which investors and service companies did not pay the necessary attention to the sales contract to cover all the chances of any dispute before, during and after the transfer of the real estate property, resulting in unpleasant and serious consequences that could only be solved through court actions.</p>
<p>Owning a property is a long-term and significant investment because of the large amounts involved. Therefore, investors, sellers and buyers, have to follow the appropriate procedures as defined by the legislative framework, during the closure of an agreement, in order to safeguard their interests.<br />
On the other hand, real estate agents, construction companies, as well as land development companies, should safeguard their rights in order to avoid adverse consequences that may arise during the closure of the agreement, i.e. cancellations, financial problems etc.</p>
<p>Therefore, appointing an experienced law firm is absolutely necessary because, as legal advisors and knowledgeable legal practitioners, they can secure the benefits of the involved parties and propose the insertion, deletion or modification of terms that, in case of a disagreement, will determine what has been agreed. Additionally, the law firm will ensure that the contract is fully compliant with the provisions of the law governing the terms and conditions of the transaction in question.</p>
<p>Additionally, law firms often act and provide escrow services for the implementation of real estate contracts. In these cases, the law firm provides the &#8220;escrow service&#8221; as a third party. This service works in between the transaction and the law firm oversees its smooth flow. Typically, this service is offered in cases where investors come from a different country than the provider. However, this service is also used in cases where all the parties involved are from the same country.</p>
<p>Moreover, legal advisors are able to advise the investors, sellers or buyers on the strategy needed to be followed in their dealings with real estate transactions and purchases. The real estate market, which will be incorporated into the investors’ portfolio of real estate, is very important and influenced by various factors that determine its future value. Let&#8217;s not forget that every investor wants to increase its income flow. The main factors to be considered for each investment transaction of this type are the location, future use, tax system, the reliability of the real estate provider and the resale strategy for the property.</p>
<p>Taking everything into consideration, I would like to highlight that, by appointing an experienced law firm, investors, buyers, sellers and involved providers, secure their rights when signing the contract and are fully informed about the legislative framework and the practical part governs the purchase and sale of real estate.</p>

<p>Οι στόχοι μας για το τρέχον έτος είναι: η επέκταση της εταιρείας σε νέες αγορές με κύριο στόχο την προώθηση της Κύπρου ως του ιδανικότερου επενδυτικού προορισμού στην Ευρώπη, η περαιτέρω αναγνώριση και ανάληψη μεριδίου αγοράς εντός Κύπρου, η περαιτέρω ανάπτυξη συνεργασιών με άλλες συναφείς εταιρείες του κλάδου μας για βελτιστοποίηση των υπηρεσιών που παρέχουμε στους πελάτες μας σε άλλες δικαιοδοσίες, καθώς και η συνεχής ανάπτυξη των τεχνολογικών συστημάτων της εταιρείας και η χρήση όλων των τεχνολογικών μέσων που υπάρχουν, κάτι που θα βοηθήσει στην καλύτερη ανάλυση των υποθέσεων και στη μείωση του χρόνου διεκπεραίωσης των εργασιών.</p>

<p><strong>Ποιοι ήταν οι πιο σημαντικοί σταθμοί στην καριέρα σας; Ποιος παράγοντας καθόρισε την πορεία σας;</strong></p>
<p>Η κάθε εμπειρία και στιγμή είχε τη δική της σημασία. Εάν μπορώ να σηματοδοτήσω ως σταθμούς κάποιες από αυτές, ξεκινώντας από την πολύ νεαρή ηλικία του λυκείου, ήταν η επιλογή του επαγγέλματος που θα ακολουθούσα, καθώς κανείς στο άμεσο οικογενειακό μου περιβάλλον δεν προερχόταν από τον τομέα της νομικής. Μετέπειτα, η θετική απάντηση από το πανεπιστήμιο που είχα επιλέξει και στη συνέχεια η πρώτη μου δουλειά στο Ηνωμένο Βασίλειο, που ήταν σε μια από τις πέντε μεγαλύτερες δικηγορικές εταιρείες στον κόσμο. Και φυσικά η δημιουργία της δικής μου εταιρείας, Chambersfield Economides Kranos, και ακολούθως του ομίλου εταιρειών GFA.</p>
<p>Δεν είναι όμως μόνο ένας ο παράγοντας που καθόρισε την πορεία μου, αλλά πολλοί. Θεωρώ πως οι παράγοντες που καθόρισαν τη μέχρι τώρα πορεία μου είναι η σκληρή προσωπική προσπάθεια και δουλειά, η επικέντρωση στους στόχους, η συνεχής ενημέρωση που φροντίζω να έχω γύρω από τους διάφορους τομείς της αγοράς, και καταληκτικά, η ομάδα μου, με την οποία μοιραζόμαστε το ίδιο όραμα και στόχους.</p>

<p>Ο τομέας στον οποίο θα με ενδιέφερε να δραστηριοποιηθώ και να δώσω ακόμη περισσότερη έμφαση είναι στην παροχή εξατομικευμένων συμβουλευτικών υπηρεσιών σε επιχειρηματίες και επενδυτές που αναζητούν εξειδικευμένο σύμβουλο ο οποίος θα είναι δίπλα τους σε όλες τις νομικές, οικονομικές και διοικητικές τους δραστηριότητες.</p>
<p>Με βάση την εμπειρία μου, η διεθνής αγορά απαιτεί σφαιρική κατανόηση, εμπειρία και γνώση, καθώς οι όροι, το νομοθετικό πλαίσιο, οι συνθήκες και οι μηχανισμοί λειτουργίας της δεν μπορούν εύκολα να κατανοηθούν.</p>
<p>Οι επιχειρηματίες του σήμερα έχουν την ανάγκη ενός νομικού / επιχειρηματικού συμβούλου που να μπορεί να τους παρέχει αναπτυξιακές στρατηγικές καθώς και επιχειρηματικά μοντέλα που θα έχουν ως στόχο την ανάπτυξη των δραστηριοτήτων τους και την αναγνώριση νέων ευκαιριών, ενώ παράλληλα το άτομο αυτό θα ασκεί προληπτική νομική / επιχειρηματική πολιτική, η οποία θα έχει ως στόχο να μετριάζει τους κινδύνους και να διασφαλίζει τα συμφέροντά τους. Ήδη συνεργάζομαι με κάποιες πολυεθνικές εταιρείες, χρηματοπιστωτικά ιδρύματα και επιχειρηματίες με την ιδιότητα αυτή και μπορώ να αναφέρω με βεβαιότητα ότι ο ρόλος αυτής της μακροχρόνιας συνεργασίας με νομικό / επιχειρηματικό σύμβουλο είναι πολύ σημαντικός, καθώς μέσα από αυτή τη συνεργασία επέρχεται η πραγματική εξατομίκευση των λύσεων και στρατηγικών, λόγω της εμπεριστατωμένης και εμπειρικής γνώσης που αποκτάται για τον συγκεκριμένο τομέα της αγοράς και τις δραστηριότητες της επιχείρησης, τόσο σε τοπικό όσο και σε διεθνές επίπεδο.</p>

										<content:encoded><![CDATA[<p><strong>BREXIT| Μάρτυρες της πρώτης Εξόδου Κράτους Μέλους της Ευρωπαϊκής Ένωσης</strong></p>

<p>Ένα από τα σημαντικότερα δημοψηφίσματα στην ιστορία του Ηνωμένου Βασιλείου πραγματοποιήθηκε στις 23 Ιουνίου 2016 με αποτέλεσμα, που ταρακούνησε συθέμελα την Ευρωπαϊκή Ένωση καθώς και την παγκόσμια αγορά.</p>
<p>Το 51,9% υπέρ της εξόδου του Ηνωμένου Βασιλείου από την Ευρωπαϊκή Ένωση, έδωσε το έναυσμα διαφόρων αλυσιδωτών αντιδράσεων στους τομείς της οικονομίας, στην πολιτική και γενικά στη φαινομενική σταθερότητα που υπήρχε.</p>
<p>Παρόλο που το δημοψήφισμα, νομικά ομιλούντες, ήταν συμβουλευτικό και όχι υποχρεωτικό, οι κυβερνήσεις ακολουθώντας, ένα άγραφο νόμο, δεσμεύονται με τα εν λόγω δημοψηφίσματα.</p>
<p>Ενώ αρχικά φαινόταν ότι σχεδόν αναμφίβολα το Ηνωμένο Βασίλειο θα προχωρούσε στην έναρξη των διαδικασιών για την έξοδό του από την Ευρωπαϊκή ένωση, στην πορεία έχει διαφανεί ότι προκύπτουν πρακτικά προβλήματα για την εν λόγω διαδικασία. Για παράδειγμα όλα τα Κοινοβούλια του Ηνωμένου Βασιλείου θα πρέπει να υπερψηφίσουν την απόφαση του δημοψηφίσματος, αλλά εκ των πραγμάτων φαίνεται ότι η Βόρειος Ιρλανδία και Σκωτία δεν θα προχωρήσουν στην υπερψήφιση της εξόδου. Πέραν αυτού οι αρχικοί υποστηρικτές και ηγέτες υπέρ της εξόδου έχουν πλέον μεταβάλει τις απόψεις τους ή έχουν παραιτηθεί από τα αξιώματά τους.</p>
<p>Σύμφωνα με το άρθρου 50 της Συνθήκης της Ευρωπαϊκής Ένωσης που καθορίζει τις διαδικασίες που πρέπει να ακολουθηθούν στην περίπτωση αποχώρησης ενός κράτους μέλους, η διαδικασία έχει διάρκεια 2 ετών εκτός και αν δοθεί παράταση με ομόφωνη απόφαση του Ευρωπαϊκού Συμβουλίου και του κράτους – μέλους.</p>
<p>Στο σημείο αυτό είναι σημαντικό να αναφέρουμε ότι το Άρθρο 50 για πρώτη φορά θα τεθεί σε εφαρμογή και οι συνθήκες για το εν λόγω κράτος προς αποχώρηση παύουν να ισχύουν από την ημερομηνία έναρξης της συμφωνίας αποχώρησης. Στην εν λόγω συμφωνία πάλι υπάρχει δυνατότητα παράτασης, σύμφωνα με τους προαναφερθέντες όρους.</p>
<p>Το αποτέλεσμα του δημοψηφίσματος οδηγεί την Ευρωπαϊκή Ένωση και το Ηνωμένο Βασίλειο, σε πρωτοφανή άγνωστα μονοπάτια. Θα κληθούν να αντιμετωπίσουν αρκετές δυσκολίες προς την υλοποίηση της εξόδου αυτής, λόγω των νομικών και οικονομικών θεμάτων που θα πρέπει να επιλύσουν. Επιπλέον, θα πρέπει να εξευρεθούν λύσεις για τα φλέγον θέματα ασφάλειας, υγείας, μετανάστευσης και άλλων που θα πρέπει να αντιμετωπιστούν με στρατηγικό και διπλωματικό τρόπο, προς αποφυγή της τυχών κατάρρευσης του συστήματος.</p>
<p>Επίσης, είναι σημαντικό να αναφέρουμε ότι στους προσεχείς μήνες δεν υφίσταται, νομικά ομιλούντες, πραγματική έξοδος του Ηνωμένου Βασιλείου από την Ευρωπαϊκή Ένωση. Ωστόσο, η αβεβαιότητα που έχει επέλθει στην Ευρωπαϊκή Ένωση και το Ηνωμένο Βασίλειο, προκαλεί συνέπειες σε όλους τους τομείς που αφορούν τις σχέσεις μεταξύ των κρατών αλλά και των επιχειρήσεων. Ήδη, η πρώτη συνέπεια διαφάνηκε την 24η Ιουνίου, λίγες ώρες μετά την ανακοίνωση του αποτελέσματος, όπου ως μάρτυρες παρατηρήσαμε τη δραματική συναλλαγματική υποτίμηση της Αγγλικής στερλίνας, σημειώνοντας τη μεγαλύτερη πτώση που έχει παρατηρηθεί τα τελευταία 30 έτη. Αυτή η συναλλαγματική υποτίμηση, σίγουρα θεωρείται ως η προκήρυξη της έναρξης των πρώτων προβλημάτων στην οικονομία.</p>
<p>Το Ηνωμένο Βασίλειο αποχωρώντας από την Ευρωπαϊκή Ένωση, θα πρέπει σε πρώτη φάση να αντιμετωπίσει το δημοσιονομικό χρέος της τάξεως των 30 δισεκατομμυρίων στερλίνων, ενώ παράλληλα υπάρχει η πιθανότητα προκήρυξης άμεσης ανάγκης ρευστότητας στις τράπεζες του, του ύψους των 250 δισεκατομμυρίων στερλίνων.</p>
<p>Αδιαμφισβήτητα, η πτώση της Αγγλικής λίρας σε συνάρτηση με το δημοσιονομικό χρέος και της ανάγκης ρευστότητας, θα δημιουργήσει στο Ηνωμένο Βασίλειο σοβαρά ζητήματα στην εσωτερική του οικονομία, τα οποία θα καλεστεί να επιλύσει ακολουθώντας νέους τρόπους ανάπτυξης.</p>
<p>Δεδομένης της δυσκολίας που θα πρέπει να αντιμετωπίσει το Ηνωμένο Βασίλειο στον οικονομικό και πολιτικό τομέα ανάπτυξης του, διαμορφώνοντας διακρατικές συμφωνίες τόσο με την Ευρωπαϊκή Ένωση καθώς και με άλλα κράτη όπως την Αμερική και την Ασία, είναι σημαίνων να αναφέρουμε ότι το Αγγλικό κοινοβούλιο ίσως καλεστεί να αποφασίσει την άρση ή την μετατροπή νομοθετικών θεσμών, που διέπουν το Αγγλικό δίκαιο. Αυτό προκύπτει λόγω του ότι πολλοί νομοθετικοί θεσμοί, που διέπουν το Αγγλικό δίκαιο, προέρχονται από την Ευρωπαϊκή Ένωση. Αυτό σημαίνει ό,τι και μετά την αποχώρησή του Ηνωμένου Βασιλείου, οι νομοθετικοί κανόνες θα παραμείνουν σε ισχύει, άρα με την νέα πολιτική προσέγγιση που θα ακολουθηθεί είναι πολύ πιθανών το Αγγλικό κοινοβούλιο να καλεστεί να αποφασίσει την άρση ή την μετατροπή τους, για να συνάδουν με τη χάραξη της νέας πορείας του κράτους.</p>
<p>Αναφορικά με την οποιαδήποτε επίπτωση στην Κύπρο, σίγουρα η Κυπριακή Δημοκρατία δεν μπορεί να παραμείνει ανεπηρέαστη, αλλά η οποιαδήποτε πιθανή αρνητική συνέπεια θα είναι προσωρινή και παροδική.</p>
<p>Προσωπικά πιστεύω ό,τι μακροπρόθεσμα, θα υπάρξουν διακρατικές συμφωνίες για την ομαλή συνέχεια της συνεργασία μεταξύ Κύπρου και Ηνωμένου Βασιλείου σε οικονομικό, πολιτικό και επιχειρηματικό πλαίσιο.</p>
<p>Περαιτέρω, μακροχρόνιες συμφωνίες επιχειρήσεων μεταξύ των δύο κρατών σίγουρα θα αναθεωρηθούν μέχρι την ολοκλήρωση της διαδικασίας εξόδου, λόγω του ότι οι πλείστες βασίζονται σε Ευρωπαϊκούς νομικούς θεσμούς. Αντιθέτως, η Κύπρος, μπορεί να επωφεληθεί από την έξοδο του Ηνωμένου Βασιλείου από την Ευρωπαϊκή Ένωση με σωστό χειρισμό και προώθηση της δικαιοδοσίας της Κύπρου σε εταιρίες κολοσσούς, οι οποίες ήδη εξετάζουν το ενδεχόμενο μετακίνησης της έδρας τους από το Ηνωμένο Βασίλειο.</p>
<p>Προσωπικά, η άποψη μου είναι ότι δεν υπάρχει άμεσος λόγος ανησυχίας για την Κυπριακή Δημοκρατία λόγω της μεταβατικής περιόδου που θα υπάρξει, όπου τα υπόλοιπα μέλη κράτη συμπεριλαμβανομένου και της Κύπρου θα προβούν σε απευθείας διακρατικές συμφωνίες με το Ηνωμένο Βασίλειο.</p>
<p>Το ερώτημα το οποίο μας απασχολεί και μπορεί να απαντηθεί μόνο εκ του αποτελέσματος, είναι εάν τελικά το Ηνωμένο Βασίλειο έπραξε σωστά και αν άλλα Ευρωπαϊκά μέλη κράτη, μετά την ολοκλήρωση της πρώτης αποχώρησης αναλογίζοντας και μελετώντας το αποτέλεσμα του Ηνωμένου Βασιλείου, διαπιστώσουν ότι τελικά μπορούν να ακολουθήσουν το παράδειγμα αυτό και να επιλέξουν αντίστοιχα την αποχώρησή τους από την Ευρωπαϊκή Ένωση.</p>
<p>Περαιτέρω, σημαντικό ερώτημα είναι το κατά πόσο όντως στην τελική, το Ηνωμένο Βασίλειο θα αποχωρήσει από την Ευρωπαϊκή ένωση, αφού πλέον είναι ορατό το ενδεχόμενο στον ορίζοντα της μεταβολής της όλης θέσης του Ηνωμένου Βασιλείου, μετά την παρουσίαση όλων των σοβαρών προβλημάτων και συνεπειών που επήλθαν στην οικονομία και στους άλλους τομείς του Ηνωμένου Βασιλείου.</p>
<p>Αδιαμφισβήτητα, πολλοί είναι οι παράγοντες που θα καθορίσουν την έκβαση της ορθότητας της απόφασης αυτής. Ο σημαντικότερος ίσως παράγοντα είναι το πώς η Ευρωπαϊκή Ένωση θα εκλάβει την απόφαση του Ηνωμένου Βασιλείου και ποιες θα είναι οι προδιαθέσεις προθυμίας της για την σύναψη συμφωνιών, με άλλους όρους και προϋποθέσεις, με ένα κράτος που ουσιαστικά την έχει απαρνηθεί και αποχωρίσει. Αφ’ ετέρου, το Ηνωμένο Βασίλειο θα πρέπει να θεσπίσει νέες στρατηγικές ως προς την αντιμετωπίσει των προκλήσεων του ανταγωνισμού καθώς και των σχέσεων μεταξύ των Ευρωπαϊκών και γειτονικών κρατών, που θα το οδηγήσουν στην υιοθέτηση νέων προσεγγίσεων και ιδεών τόσο στις μελλοντικές διακρατικές συμφωνίες που θα συνάψει όσο και στο νομοθετικό πλαίσιο που θα τις διέπουν.</p>
<p>Στο σημείο αυτό, είναι σημαντικό να αναφέρουμε ότι το αποτέλεσμα του δημοψηφίσματος δεν επηρέασε μόνο την σχέση του Ηνωμένου Βασιλείου με την Ευρωπαϊκή Ένωση αλλά και τη σχέση του με τη Σκωτία και Βόρειο Ιρλανδία. Οι χώρες αυτές ψήφισαν όπως το Ηνωμένο Βασίλειο παραμείνει στην Ευρωπαϊκή Ένωση. Μετά την ανακοίνωση του αποτελέσματος του δημοψηφίσματος, ήδη έχουν ξεκινήσει συζητήσεις για την πιθανή απόσχιση τους, από αυτό.<br />
Σοφό είναι όλοι να αναλογιστούν τις τακτικές και στρατηγικές που έχουν ακολουθηθεί οι οποίες ήταν υπαίτιες για την πρόκληση του αποτελέσματος αυτού.</p>
<p>Επίσης, θα πρέπει να αναλογιστούν και να μελετήσουν την έκβαση σε βάθος των συνεπειών του αποτελέσματος και να προβούν άμεσα σε καθησυχασμό, θεσπίζοντας στρατηγικές εξυγίανσης για τη μείωση της αστάθεια που έχει προέλθει, έτσι ώστε να επέλθει η ψυχραιμία και να δοθεί ο ανάλογος χρόνος, προς την υλοποίηση των διαδικασιών που πρέπει να ακολουθηθούν.</p>
<p>Οι αξιωματούχοι, δε, των κρατών μελών και της Ευρωπαϊκής Ένωσης θα πρέπει να εξετάσουν την πορεία της «επόμενης ημέρας» και τα προβλήματα που οδήγησαν το Ηνωμένο Βασίλειο να αποσυρθεί από την Ευρωπαϊκή Ένωση. Να αξιολογήσουν κατά πόσον ο τρόπος λειτουργίας, σήμερα, της Ευρωπαϊκής Ένωσης είναι ορθός, στα πλαίσια αλληλεγγύης και υποστήριξης των μελών κρατών ή εάν χρήζει ολοκληρωτικής και ριζικής αναδιοργάνωσης.<br />
Σίγουρα, κανείς δεν γνωρίζει εάν μακροχρόνια η απόφαση αυτή, του Ηνωμένου Βασιλείου να αποσυρθεί από την Ευρωπαϊκή Ένωση, θα είναι αρνητική ή θετική λόγω των πολλών πολύπλευρων παραγόντων που επηρεάζουν το αποτέλεσμα.</p>
<p>Βραχυπρόθεσμα ωστόσο, η αστάθεια που έχει επέλθει γενικά για το «τι μέλλει γενέσθαι», αναμφίβολα θα επιφέρει αρνητικές συνέπειες στους τομείς των εμπορικών και οικονομικών συναλλαγών, παγκοσμίως.</p>

										<content:encoded><![CDATA[<p>On June 23rd, 2016, the vote of the public that became known at the early hours of 24th of June undoubtedly marked the referendum as one of the most important in the United Kingdom and by extension the European Union.</p>

<p>According to the exit polls predictions, the majority of the English citizen’s vote showed that United Kingdom would remain in the European Union. But the final actual result of the referendum overturned all predictions as the largest rate of 51.9% voted in favor of the United Kingdom exit over 48.1% that voted the continuation in the European Union.</p>
<p>From the legal point of view, this referendum is advisory and not mandatory. However, it is customary that governments are bound by these referendums.</p>
<p>Therefore, the United Kingdom will indisputably set off the procedures for exiting the European Union.</p>
<p>Pursuantly, under the European Treaties, the withdrawal of a Member State must be completed within the period of 2 years. Of course, the discretionary power of the unanimity vote of the member states of EU confers the possibility for period extension.</p>
<p>In addition, the unpredictable result positioned the European Union and the UK in unprecedented unknown paths. Undoubtedly a number of legal and economical difficulties will occur on the implementation of the referendum result that UK will be called to resolve. Moreover, during the negotiation process of the orderly withdrawal of the UK, measurements for safety, health, immigration and for many others sectors should be decided in a wise manner in order to avoid the collapse of the system.</p>
<p>At this point, it is worth mentioning that in the next few days, weeks and months, legally speaking, the UK exit from the European Union is not real. But, the uncertainty that the referendum brought, today, in the world of the European Union and the United Kingdom, activated a “domino effect” on all areas related to the multinational relations between states and businesses. Already, this morning we observed the first outcome of the referendum; the British pound suffered its largest exchange devaluation in 30 years that triggered the opening of major chain problems in the economy.</p>
<p>Thus, the UK withdrawal from the European Union will generate a &#8220;black hole&#8221; in the Public debt of approximately 30 billion English Pounds. In addition, it is possible for UK Banks to accrue the necessary liquidity to UK banks amounting to 250 billion pounds. This result is in line with the decline of the British pound, it is almost certain that it will create the UK Serious problems in the internal economy.</p>
<p>Furthermore, with respect to any incidence in Cyprus, certainly the Republic of Cyprus cannot remain unaffected, just like the other Member States, by this development.</p>
<p>My personal opinion is that in the long term, there will be intergovernmental agreements for the smooth continuation of the cooperation between Cyprus and the United Kingdom in the economic, political and business context.</p>
<p>However, the instability will occur until the completion of the UK leaving the European Union will result in numbness of trade between Cyprus and the United Kingdom. This will occur because the large number of English companies are either directly or indirectly in Cyprus, using the United Kingdom licenses which are based on European institutions for their operations within the Republic of Cyprus.</p>
<p>Further, long-term business agreements between the two states should be reviewed until the completion of the output process, since most based again in European legal institutions.</p>
<p>Personally, I do not believe that there is an immediate concern for the Republic of Cyprus if there will be a transition period, where the other member states including Cyprus will be able to make direct interstate agreements with the United Kingdom.</p>
<p>A big issue which should come under discussion between the Member States of the European Union, is whether it is &#8220;The principle of the EU end?&#8221;.</p>
<p>It is important to consider all of the responsibilities and actions that led to the UK people to vote on leaving the EU. At this point I would like to mention that Scotland and Northern Ireland, which voted as the UK remains in the EU are already discussing their possible secession. Also, the other Member States by means of their MEPs have open discussion topics for review of their stay in the European Union.</p>
<p>Nobody knows if long this decision, the United Kingdom to withdraw from the European Union, will be negative. There is the possibility of long term prove the correctness of this move and what will emerge from the implementation strategies to be implemented in the United Kingdom.</p>
<p>However, short term volatility that has begun to occur in the European Union pillars and the Member States for &#8220;what happens next&#8221; will undoubtedly have negative consequences in the areas of trade and investment.</p>
<p>It also stressed that the officials of the Member States should consider the state of the &#8220;next day&#8221; and ponder the problems that led the United Kingdom to withdraw from the European Union and whether the way in which the EU currently operates is correct in the context of solidarity and support of the Member States or if you need complete and radical overhaul of the EU institution.</p>
